I just got this “Fair Access Policy” violation from DishNet.  They cut us back on our bandwidth based on rolling 30 days of bandwidth use.  This is not the first time for us, especially when our college age kids are home.  Are these types of limits typical?  Can anyone suggest a better provider for satellite internet?  We live in the boonies so cable or FIOS or DSL is not available.  I can understand limits based on billing cycles but such ones based on a rolling 30 days seem stupid.  Am I being unreasonable?

Dear DISH Network customer,

To ensure that all DISH Network customers have equitable access to the satellite network, we have set a rolling 30-day limit on data customer usage per customer, called Usage Threshold, which is detailed in our Fair Access Policy (FAP).

You have used more data in the last 30 days than is allowed on your current service plan’s Usage Threshold.  As a result, your DISH Network High-Speed Internet powered by WildBlue access speeds have been slowed down in accordance with the FAP, which can be viewed at legal.dishmail.net.  You will still be able to use the Internet access service but your speeds will be slower.  Your service will be returned to its previous operating levels once your cumulative previous 30-days usage has decreased to 70% of your Usage Level.  Please be aware that future occurrences, whether intentional or not, can result in a slowdown of your service again. 

High data usage is commonly caused by the downloading and/or uploading of large files or large quantities of files.  If the cause of this excessive usage can be accounted for by yourself or another user of the system, you should verify that all users are aware of the FAP regarding excessive usage.  You may also want to take measures to ensure that usage is kept within acceptable levels.  To view your current usage statistics, visit HYPERLINK “http://www.dishmail.net/www.dishmail.net, select the My Account link in the top banner, log in using your primary email address, and select the Usage tab.

If, after discussing this matter with all users of the service, the excessive usage cannot be accounted for, it may have been caused by the misuse of your system by an outside person.  Unfortunately this would mean that the security of your system has been compromised, and will need to be secured as soon as possible.  To remedy this issue, we recommend you follow these steps:

1.  Ensure that you have applied all critical patches and service packs to your operating system (i.e. Windows).  These are available at http://windowsupdate.microsoft.com/http://windowsupdate.microsoft.com.  Microsoft Internet Explorer is required to access this page.

2.  Ensure that your anti-virus software is up to date.  New virus definitions come out frequently; if you are uncertain whether your software is current you will need to verify that you have the most recent updates.  Most programs can be configured to update on their own.  At the time your service was installed, you should have received F-Secure anti-virus software either downloaded from the Internet or on a CD.  If you do not have anti-virus software, you should install a current version as soon as possible; multiple options can be found at most retail stores, or you can download F-Secure by going to HYPERLINK “http://www.dishmail.net/www.dishmail.net, select the My Account link in the top banner, log in using your primary email address, and click the link in the Protect Your Computer section.

3.  Have your computer serviced by a PC or network professional.  In a large number of cases, it is possible there has been a breach in the security of the affected computer.  This could possibly lead to more severe issues, or a recurrence of excessive usage coming to our attention.
